An ESA letter is a signed document from a Florida-licensed mental health professional — LP, LCSW, LMFT, LMHC, or psychiatrist — confirming that you have a disability and that an emotional support animal provides therapeutic benefit. Under the federal FHA and the Florida Fair Housing Act (Fla. Stat. § 760.20 et seq.), this letter entitles you to keep your ESA in housing that would otherwise prohibit pets.

How is a Florida ESA letter different from a pet certificate?

Can Florida landlords reject my ESA?

Only in very limited circumstances — if the specific animal poses a direct threat to the health or safety of others, or if the accommodation causes an undue hardship. A general no-pet policy is not sufficient. The FHA and the Florida Fair Housing Act require Florida landlords to engage in an interactive accommodation process.

Can Florida landlords charge pet fees for my ESA?

No. ESAs are assistance animals under the FHA and the Florida Fair Housing Act — not pets. Florida landlords in Miami, Tampa, Orlando, Cape Coral, Gainesville, and across all 67 counties cannot charge pet fees, pet deposits, or monthly pet rent for ESAs.

Do Florida PSD letters require the same clinician?

Yes. Florida PSD letters must come from a Florida-licensed mental health professional with a genuine therapeutic relationship. The clinician confirms the patient has a psychiatric disability and that the dog is trained (or in training) to perform specific tasks.

Can Florida housing deny a PSD?
